SUB-2014-0001/REZ-2014-0001: Preliminary Plat of 12th Avenue and Vercler Road, and Rezone from R-3 Zoning District to R-4 Zoning District. Summary of decision: Approve applications, subject to conditions of approval. The preliminary plat will expire on October 9, 2021; unless a time extension request is submitted and approved under Section 20.30.060 of the Spokane Valley Municipal Code (SVMC).
VAR-2014-0002: Variance from Side Yard Setback Requirements, in the Garden Office (GO) Zone. Summary of decision: Based on the Findings of Fact and Conclusions of Law, the application for a variance to reduce the side yard setback in the (GO) zone for a proposed office building from 20 feet to 5 feet along the east border of the site, adjacent to the R-3 zoning district, is hereby approved; subject to the conditions of approval specified below.
This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction over land development.
REZ-2014-0002: Rezone from the R-3 Zoning District to the R-4 Zoning District. Summary of decision: The Hearing Examiner issued a decision on November 12, 2013 that approved a rezone of the site from the R-3 district to the R-4 district, in File No. REZ-2013-0002. The decision incorrectly described the site as part of a former tax parcel that included the land making up site and the easterly .49 acres of the land lying directly west of the site, based on a description error in the staff report submitted in File No. REZ-2013-0002. Due to an oversight, the 2013 rezone of the site to the R-4 district was not mapped by the City on its official zoning map. The current decision reaffirms the rezoning of the site to the R-4 district, to the extent the 2013 rezone of the site to the R-4 district is not recognized by the City.
SUB-2014-0002: Preliminary Plat of Mathis Addition, in the R-3 Zoning District. Summary of decision: Approve preliminary plat, subject to conditions. The preliminary plat will expire on December 16, 2021; unless a request for an extension of time is timely submitted at least 30 days prior to such expiration date.
